TLTB ENFORCEMENT OF COURT ORDERS

The iTaukei Land Trust Board (TLTB) has given more than ample time to its tenants to comply with Court orders to pay their rental arrears. On 9 May, 2025 TLTB began enforcement actions against those tenants who continued to disobey Court orders to pay their rental arrears.

This enforcement actions include the disconnection of utilities including electricity and water supply and even eviction and vacant possession.

Of the eight cases scheduled for enforcement of Court orders:

1 tenant settled their arrears before the execution of the court orders

1 tenant settled their arrears before the disconnection of WAF water meters

1 paid on site during execution in Nausori

1 cleared their dues on Tuesday, 13th May 2025 after the disconnection

For the four remaining defaulters, water supply has been disconnected. However, TLTB in its sole discretion granted 14 days for the tenants to settle arrears. If no payment is received within this period, electricity disconnection will follow.

Failure to comply may lead to full eviction and vacant possession, especially for tenants with improvements on leased land. Note that TLTB has already obtained Court orders for this.

TLTB wishes to emphasise that eviction and vacant possession is a last resort measure as TLTB wishes to allow its tenants the opportunity to pay their arrears and keep their homes.

Note, however, that TLTB’s statutory mandate is to act for the benefit of and protect the rights of the landowners to ensure they receive fair and equitable returns to their land in terms of timely payments of lease rentals.
